People who have been detained in a Mental Health Unit for assessment (under Section 2) or treatment (under Section 3), have the right to appeal to a Mental Health Tribunal.  The Tribunal independently reviews the patient’s detention and has the power to order the patient’s discharge from hospital.

In most instance a patient can also ask for his/her detention to be reviewed before a Hospital Manager’s Hearing that has similar powers to the Tribunal.

People who are detained in a Mental Health Unit under a Hospital Order, following a criminal conviction, may also have their detention reviewed by a Tribunal.

The Mental Health Tribunal can also review whether a Community Treatment Order should remain in place.
