Edwards Duthie Shamash have been successful in two cases before the Nursing & Midwifery Council concerning allegations brought against a Registered Nurse.

In one case we were successful in challenging allegations of cruelty and inappropriate care against our client, successfully submitted to the Nursing & Midwifery Council that there was no case to answer. The allegations were therefore dismissed without our client being called upon to present any evidence in response.

In another case we were successful in resisting an application by the Nursing & Midwifery Council that our client should be suspended from practice pending an investigation into a case where, sadly, a patient had died as a result of neglect. The NMC Panel accepted our submissions that the evidence suggested that the responsibility for this unfortunate outcome lay elsewhere and that it would, in any event, be unfair and disproportionate for our client to be suspended.

Both cases were dealt with by a team headed by Shaun Murphy.
